DMCA & Copyright Takedown Policy
Static Labs LLC respects the intellectual property rights of others and expects users of Kubian to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using the Kubian service that are reported to our designated legal team.
Submitting a Notice
If you are a copyright owner, or authorized to act on behalf of one, please report alleged copyright infringements by sending a formal notice to:
Your notice must include the following information:
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity.
- Your contact information, including your address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Review & Processing Timeline
All formal requests sent to [email protected] are systematically logged and thoroughly reviewed by our legal operations team within 1 to 2 weeks (7 to 14 business days).
Upon verification of a valid DMCA request, we will take appropriate action, which may include disabling access to or removing the specified content and notifying the affected project administrator.
Counter-Notification Process
If you believe that material you posted or integrated was removed or disabled by mistake or misidentification, you may submit a written counter-notification to [email protected] containing the following information:
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, physical address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Oregon if located outside the United States), and that you will accept service of process from the person who provided the original DMCA notification.
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If the copyright owner does not file a court action seeking a court order within 10 to 14 business days, Kubian reserves the right to restore or re-enable access to the material at our discretion.
